The application of the Davis-Bacon and Related Acts (DBRA) to federal and federally assisted construction projects leaves many contractors uncertain about the requirements of federal prevailing wage laws and the consequences of non-compliance. Failure to comply puts covered contractors at risk of catastrophic consequences, from losing money on contracts due to failure to understand labor costs, to high dollar back pay and related penalties, to debarment from future federal work. Adding further confusion, the U.S. Department of Labor (DOL) recently enacted a massive overhaul and update to the regulations governing the DBRA. This three-part webinar series seeks to help such contractors avoid those risks by educating staff tasked with DBRA compliance and administration on coverage, requirements, pitfalls, and enforcement of these laws.

Webinar One: Wednesday, February 21, 2024 | 10:00 am – 11:00 am (HST)
This webinar is designed to give covered federal prime and subcontractors a more detailed understanding of what changes were made with the DOL’s recent update.  Presenters will walk attendees through the pre- and post-final rule requirements for major DBRA topics and include information on the changes in setting prevailing wage rates.

Webinar Two: Thursday, February 22, 2024 | 10:00 am – 11:00 am (HST)
This webinar is perfect if you are a new staff person responsible for federal contract or subcontract compliance or you have been in your role for a while and need a refresher course. It will provide you with a basic overview to help understand the requirements of the Davis-Bacon and Related Acts in a contractor-friendly manner.

This webinar will perform a deeper dive into the intricacies and complex challenges of the laws. It will provide attendees with an advanced understanding of the requirements of the Davis-Bacon and Related Acts and provide valuable best practices.

Leslie Stout-Tabackman regularly counsels and represents clients with matters before the U.S. Department of Labor's (DOL) Wage and Hour Division, including Fair Labor Standards Act (FLSA) issues and prevailing wage and benefits issues arising under the Service Contract Act (SCA), the Davis-Bacon Act (DBA), and requirements under related Executive Orders and the FAR. Her prevailing wage practice includes counseling federal contractors and providing comprehensive training on SCA and DBA prevailing wages and benefits requirements, coverage, exemption and worker classification issues, and related contracting procedures from the solicitation and bid stage through completion of the contract. conducting voluntary FLSA compliance audits. She regularly works with contractors to conduct internal compliance audits and provides education and training sessions for clients on these topics. Her practice also includes prevailing wage and related laws and Executive Orders due diligence reviews in buy/sell transactions.

Timothy led WHD in the revitalization of the government contracts enforcement and compliance assistance programs, ensuring that workers on projects funded through the American Recovery and Reinvestment Act received the wages and benefits to which they were entitled. He oversaw the increase of DBA investigations from a low of 300 per year to more than 1,800 investigations per year. He also conducted more than 29 prevailing wage seminars throughout the United States, providing compliance assistance to more than 8,000 attendees.
